This disclaimer applies to your use of the SGS website (summitgrowthsystems.com.au) and any information, services, software, or AI tools we make available. By using our website or services, you accept this disclaimer.

1. General information only

The information on our website is general in nature. It is not professional, legal, financial, medical, or business advice. Before acting on anything you read here, get your own advice from a qualified professional in the relevant field. We do not guarantee that information on our site is current, accurate, or complete.

2. No business outcome guarantee

We sell business automation, AI receptionist, and web development services. We do everything we reasonably can to help our clients grow, but we do not guarantee specific business outcomes — including specific lead volumes, conversion rates, revenue, sales, customer retention, or return on investment. Results depend on factors outside our control, including the client's business, market conditions, and how the client uses our services.

3. Service availability

We aim to provide our services without interruption. We use commercially reasonable efforts to keep our services running, but we do not guarantee 100% uptime, error-free operation, or freedom from delays. Our services depend on third-party platforms, internet infrastructure, and telecommunications carriers. Where those third parties have outages or downtime, our services may be affected. We are not responsible for outages outside our reasonable control.

4. AI-generated content and AI Receptionist accuracy

Some of our services use artificial intelligence — including the SGS AI Receptionist, which answers inbound calls on behalf of our clients, and AI-powered automations that classify and respond to messages.

AI is not perfect. AI-generated outputs — including transcripts, summaries, message classifications, and automated responses — may contain errors, omissions, or misclassifications. Our clients are responsible for reviewing AI-generated content before relying on it for business decisions. We do not warrant the accuracy of AI outputs.

If you are calling a business that uses the SGS AI Receptionist, the AI will identify itself at the start of the call. The call is recorded and transcribed so the business can follow up. Full details of how we handle voice and text data are in our Privacy Policy.

5. Restricted sectors — services with limited availability

For businesses operating in the following sectors:

  • NDIS-registered or unregistered disability services
  • Aged care providers
  • Healthcare clinics and medical practices
  • Allied health professions (including physiotherapy, psychology, podiatry, optometry, audiology, dietetics, and similar)
  • Mental health services
  • Pharmacies
  • Medical specialists
  • Any business whose primary service involves the collection of health information

The following services are not available:

  • SGS AI Receptionist
  • Any SGS Automation feature that captures, stores, or processes voice recordings, transcripts, or other sensitive personal information

This is because our underlying platform (described in our Privacy Policy) is not configured for storing health information regulated under the Privacy Act 1988 (Cth) and related legislation.

The following services may be available, on a scoped basis, where the configuration does not capture health, disability, or other sensitive information:

  • SGS Web Development
  • SGS SEO and content services
  • Generic SGS Automation features that do not capture sensitive information (for example, generic lead follow-up SMS, basic CRM record-keeping, generic appointment reminders) where data fields are restricted to non-sensitive categories

6. Third-party platforms, links, and content

Our website may link to third-party websites, tools, or platforms. We do not control those third parties, do not endorse their content, and are not responsible for their accuracy, privacy practices, or availability.

Our services rely on third-party infrastructure providers (telecommunications carriers, cloud hosting, payment processing, AI services, and others). These are listed in categories in our Privacy Policy, and a complete sub-processor list is available to clients on request. Where a third party's service fails, our service may be affected. Our liability for third-party failures is limited as set out in our Terms & Conditions.

7. Pricing, packages, and availability

Pricing shown on our website is in Australian dollars and excludes GST unless otherwise stated. Tax invoices issued at checkout will include GST as required by the A New Tax System (Goods and Services Tax) Act 1999 (Cth). Pricing, package inclusions, and availability are subject to change. The Foundation Member offer is limited in number and time and is subject to specific terms set out in our Terms & Conditions.

8. Australian Consumer Law

Nothing in this disclaimer excludes, restricts, or modifies any consumer guarantees, rights, or remedies you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot be excluded by contract.

Where we are permitted by law to limit our liability, our liability for breach of any non-excludable consumer guarantee is limited (at our option) to:

  • supplying the services again, or
  • paying the cost of having the services supplied again.

9. Insurance

We do not represent that we hold any specific insurance cover unless we have explicitly told you so in writing. If you require us to hold specific insurance for a particular engagement, this must be agreed in your service agreement.

10. Australian law

This disclaimer is governed by the laws of Queensland, Australia. Any dispute arising from your use of our website or services is subject to the exclusive jurisdiction of the courts of Queensland and the Federal courts of Australia.

11. Updates

We may update this disclaimer at any time. The current version is published at summitgrowthsystems.com.au/disclaimer with the effective date at the top. Material changes will be notified to active clients in line with our Terms & Conditions.
